Equipment that do not have a recharging circuit, and which are not directly connected to the mains and are powered over USB are not in the scope of Regulation 2023/826, while similar equipment with a recharging circuit are in the scope. This is also in line with Recital (12) of the Regulation: “Portable battery-operated products with a recharging circuit that have to be plugged in to recharge should be covered by this regulation, because they depend on energy input from the mains”. Therefore, a webcam or computer mouse that only works when the computer is on and cannot be connected to the mains for recharging does not fall in the scope of Regulation 2023/826.
